Terms & Conditions
These terms are a binding agreement between you and Hypermilers ("we", "us"). They govern your use of the Hypermilers Android app and the hypermilers.tech website (together, the "Service"). By creating an account, continuing with Google, or using the Service, you agree to these terms and to the Privacy Policy. If you do not agree, do not use the Service.
1. Agreement and eligibility
You must be at least 18 years old, and legally able to enter into a contract, to create an account or purchase a subscription. By using the Service you confirm that you meet these requirements and that the information you provide is accurate.
These terms do not limit any mandatory right you have as a consumer, including rights under Egyptian Consumer Protection Law No. 181 of 2018.
2. What the Service is
Hypermilers is a record-keeping tool for vehicle owners. It stores the vehicles you add, service intervals and reminders, maintenance history, fuel and expense entries, and derived cost statistics for your own account.
The Service records what you tell it. It does not inspect your vehicle, diagnose faults, perform maintenance, provide mechanical or legal advice, or verify the accuracy of imported data.
3. Your account
- You can register with an email address and password, or continue with Google.
- You are responsible for keeping your credentials secret and for activity on your account.
- One account belongs to one person. Do not share an account or resell access to it.
- You must accept these terms and the Privacy Policy when you register and on first Google sign-in. If the documents change materially, you will be asked to accept the updated version before continuing.
- Tell us promptly at [email protected] if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- use the Service unlawfully, or to store data you have no right to hold;
- access another person's account or another account's records;
- attempt to probe, scan, overload, disrupt or circumvent the security, authentication, rate limits or plan limits of the Service;
- reverse engineer, decompile or extract the source code of the Service except where the law expressly permits it;
- resell, sublicense, or provide the Service as a bureau service to third parties without our written permission;
- abuse purchase verification, for example by reusing a Google Play purchase token on more than one account or by requesting refunds after using a paid period; or
- upload malicious code, or content that infringes someone else's rights.
We may suspend or limit an account that breaches this section, after notice where that is reasonable, or immediately where the breach puts other accounts, our systems or a third party at risk.
5. Your content and licence
You keep all rights to the vehicle, service, fuel, expense and note data you enter, and to any profile photo you upload (together, "Your Content"). You grant us a limited, non-exclusive, royalty-free licence to store, process, transmit and display Your Content solely to operate the Service for you and to provide support you request.
This licence ends when you delete the content or your account, apart from copies retained in backups or archives for a limited period and records we must keep by law. We do not use Your Content for advertising, profiling, product marketing or third-party analytics.
You are responsible for Your Content, including its accuracy and your right to hold it. You must not upload content that infringes another person's intellectual property, privacy or other rights.
6. Our intellectual property
The Service, the Hypermilers name, logo, artwork, interface, and the software behind them are owned by us or our licensors and are protected by intellectual property law. These terms grant you a personal, non-transferable, revocable licence to use the app on your own devices for its intended purpose. No other rights are granted.
7. Subscriptions and payment
The app has a free tier and an optional paid tier ("Pro"). Subscriptions are sold and billed by Google Play, not by us. The price, billing period, any free trial and any promotional offer are shown by Google Play before you confirm a purchase.
- Subscriptions renew automatically unless you cancel in Google Play before the renewal date.
- We verify each purchase with Google Play before granting Pro access.
- If a payment fails or a subscription enters a grace or hold period, we follow the state reported by Google Play. Your records are never deleted because a subscription lapses.
- Cancellation, refunds and cooling-off rights are described in the Subscription & Refund Policy.
8. Availability and changes
We aim to keep the Service available and reliable, but we do not promise uninterrupted or error-free operation. The Service may be unavailable during maintenance, upgrades, hosting incidents, or outages outside our control.
We may add, change, or remove features. If we remove a paid capability during a period you have already paid for, we will provide a reasonable substitute or a proportionate refund. We may also stop offering the Service entirely; in that case we will give reasonable notice and a period to retrieve your data.
9. Third-party services
The Service depends on third parties: Google Play for distribution and billing, Google for optional sign-in, and our hosting providers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for their acts or omissions, but we choose them with care and require them to protect your data as described in the Privacy Policy.
10. Disclaimers
The Service is a record-keeping tool provided "as is" and "as available". To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Vehicle decisions remain yours. Service intervals, reminders and statistics are calculated from the values you enter. Always follow your vehicle manufacturer's requirements and a qualified mechanic's advice. Never delay safety-critical maintenance because of a reminder, a statistic or a missing notification.
Notifications and reminders depend on your device, its battery optimisations and the permission you grant. We cannot guarantee that a reminder will be delivered, or delivered on time.
11. Limitation of liability
To the fullest extent permitted by law, and except as set out below, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, vehicle damage, missed maintenance, or business interruption arising from your use of the Service.
Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us, through Google Play, in the twelve months before the event giving rise to the claim, or (b) EGP 1,000.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or any mandatory consumer right under Egyptian law.
12. Suspension and termination
You may stop using the Service at any time and delete your account as described in the Account Deletion Policy. We may suspend or terminate your access if you materially breach these terms, if we are required to by law, or if we discontinue the Service. Where it is reasonable and lawful to do so, we will give you notice and an opportunity to correct the problem.
Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and governing law — continue to apply.
13. Account deletion
Deleting your account disables access to it and removes it from our identity service. The Account Deletion Policy explains how to delete an account, what is removed immediately, what is retained for legal or accounting reasons, and how to request permanent erasure of everything.
14. Governing law and disputes
These terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict of law rules. The courts of Cairo have exclusive jurisdiction over disputes arising from these terms, except where mandatory consumer law in your country of residence gives you the right to bring a claim in your local courts.
Before starting formal proceedings, please contact [email protected] so we can try to resolve the issue directly. We will attempt to resolve complaints within 30 days.
15. Changes to these terms
We may update these terms to reflect changes in the Service, in the law, or in how we operate. The effective date and version at the top of this page identify the current text. If a change is material, we will ask you to accept the updated terms in the app before you continue using the Service, and the version you accepted is recorded against your account.
16. General
- Entire agreement. These terms, the Privacy Policy, and the Subscription & Refund Policy are the whole agreement between us about the Service.
- Severability. If a provision is found unenforceable, it is limited to the minimum extent necessary and the remaining provisions stay in force.
- No waiver. If we do not enforce a right immediately, we do not waive it.
- Assignment. You may not transfer your rights under these terms. We may transfer our rights and obligations to a successor operator of the Service; we will notify you if we do.
- Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control.
- Language. These terms are published in English. Translations, if provided, are for convenience; the English text prevails where the law permits.
